The Grand County District Court in Hot Sulphur Springs, Colorado, recently upheld the right of a TCLG client, a real estate agent, to record a Lis Pendens in a lawsuit arising out of a property investment in which the agent is also a member of the LLC that owns the property. The Court rejected the argument that the lawsuit was not one that could affect title to the property itself. The Court also denied the Defendants’ request for an injunction to remove TCLG’s client as the listing agent for the property.
