Mark Cohen successfully represented TCLG’s client in a three-day bench trial in Boulder District Court arising out of series of small loans the client made to neighbors (husband and wife) to help them avoid foreclosure and preserve their farm and equine operation. The firm’s client had made the loans, at the request of the wife, without requiring the neighbors to execute promissory notes and without requiring any security. After the neighbors divorced the ex-wife became ill and was unable to repay the loans. The ex-husband denied any liability, claiming the law could not hold him liable for debts incurred by his ex-wife. TCLG filed suit against the ex-wife and the ex-husband for breach of contract and unjust enrichment. At the conclusion of the trial the Court ruled in favor of the firm’s client, finding that the ex-husband had been unjustly enriched. The Court also rejected the ex-husband’s contention that the divorce court’s prior rulings regarding the division of certain marital debts precluded the client’s suit against him. The total amount of the loans exceeded $150,000.00.
