TCLG’s Mark Cohen successfully represented the firm’s client in a 3-day trial in Adams County District Court. The firm’s client filed suit to collect damages arising out of its lease of a Terex/Pegson rock crusher to a customer to crush concrete into class 6 road base. The customer counterclaimed for misrepresentation and breach of contract. After a 3-day trial, Judge John T. Bryan concluded that the lease drafted by TCLG precluded some of the Defendant’s claims as a matter of law. The Court also concluded that the Plaintiff’s witnesses were more credible than those of the Defendant. The Court awarded attorney’s fees and costs to the firm’s client pursuant to the terms of the lease. 5/17/09
